These Terms and Conditions are set for the goods sold by us through this website. Please read these terms and conditions carefully and ensure that you understand them before placing the order. If you do not agree to comply with and be bound by these terms and conditions, you will not be able to order goods through our site.
- Interpretation
Any reference to "Web Site" is to a Web Site owned and operated by GB Chocolate Makers Ltd. "we, us, our, ourselves" means GB Chocolate Makers Ltd., Unit 1, Common Lane North, Beccles, Suffolk, NR34 9BN. Registered in England and Wales company number 12290619. "you, your, yourself" means the person who uses our website. "goods" means the goods sold by us through our site, “contract” means a contract for the purchase and sales of goods; “order’ means your order of goods; “dispatch confirmation” mean our acceptance and confirmation of your order; for purchase on our website and ordered from us by you.
We reserve the right to alter, suspend or discontinue our site (or any part of it) at any time and without notice. We will not be liable to you in any way if our site (or any part of it) is unavailable at any time and for any period.
- Delivery
All Goods purchased through our site will normally be delivered within the times given on the site during the order process.
Delivery options and related charges will be presented to you as part of the order process.
If we are unable to deliver the Goods on the delivery date (if, for example, no one is available at your address to receive the Goods) We will follow any delivery instruction you may have given or attempt to leave your goods in a safe place. If this is not possible, our carrier will leave a note advising of where your goods have been returned to and how to either arrange re-delivery or collect them.
In the unlikely event that we fail to deliver the goods within the times given on the site you are entitled for full refund.
- Risk in and Ownership of the Goods
Delivery shall be considered complete once we have delivered the goods to the address including, where relevant, any alternative address provided in your order. Risk in the goods shall pass to the you on delivery.
Ownership of the goods passes to you once we have received payment in full of all sums due (including any applicable delivery charges).
You may cancel all or part of your Order. Any sums that you have already paid for cancelled goods and their delivery will be refunded to you. Please note that if any cancelled goods are delivered to you, you must return them to us. We will not bear the cost of returning the cancelled goods.
- Goods, Availability and Price
We make all reasonable efforts to ensure that all descriptions and graphical representations of goods available from us correspond to the actual goods. Images of goods are for illustrative purposes only. There may be slight variations in colour between the image of a product and the actual product sold due to differences in computer displays and lighting conditions.
All the goods are made in the same environment as nuts, gluten and dairy so we cannot guarantee they are free from nuts, gluten and dairy traces.
All prices are checked by us when we process your order. In the unlikely event that We have shown incorrect pricing information we will contact you in writing before proceeding with your order to inform you of the mistake and to ask you how you wish to proceed. We will give you the option to purchase the Goods at the correct price or to cancel your order. We will not proceed with processing your order until you respond.
- Payment
Payment for Goods and related delivery charges is payable during the order process. We accept no liability if a delivery is delayed because you have not given us the correct payment details. We accept Visa, Mastercard, American Express, Credit Cards, PayPal, shopifyPay and ApplePay.
- Damages or shortages Goods
Damages and shortage must be notified to us as soon as reasonably possible to inform us to arrange for a refund, repair or replacement.
- Warranties
By law, we must provide goods are of satisfactory quality, fit for purpose, as described at the time of purchase, in accordance with any pre-contract information We have provided.
If you wish to make a claim under this warranty, you shall give us written notice with 14 days of the discovery of the defect and give a reasonable opportunity to inspect the goods in question.
Our liability under the warranty shall be limited to replacing the goods or refunding the price of goods.
- Limitation of Liability
We will not be responsible for any loss or damage unless you notify us in writing at our contact address of the problem within 7 days of the date on which the products were due for dispatch to you. If you notify to us under this condition, our only obligation will be to refund the amount paid by you for the products in question.
Nothing in these terms and conditions is intended to limit any right you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
- Force Majeure
If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to fire, industrial disputes or civil commotion, it shall notify the other and the first party’s obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.
- Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
